Your Content, Rights, and Permissions:

Our platform allows you to modify and alter your existing creative material. By using our platform, you acknowledge that this material, which will henceforth be referred to as your « works, » is your own intellectual property and not the intellectual property of any other person or entity. Senmixmaster claims no rights to this material, and the intellectual property and copyright in your works remain yours when you use our service. You may not copy, download, or share content that is not your intellectual property unless you have the express consent to do so from the party or parties that own the content. If you violate someone else’s copyright or intellectual property rights while using our service, Senmixmaster is not liable for any damages you incur as a result of such violations, and by using our platform, you grant us the right to terminate or suspend your account due to such violations. By using our service, you agree that Senmixmaster will host, share, and modify your intellectual property while you use our platform, and you consent to us and the trusted entities we work with backing up, storing, and sharing your works with you. We are not responsible for ensuring that the content you share with the platform complies with the principles mentioned above and in the future. Use of our platform may require verification or authentication of your personal email address, or other means of password encryption to maintain the confidentiality of your account. It is your responsibility to maintain the integrity of this information and not to share your account or login details with any other parties. If other parties access your account, you will be responsible for their use of said account. If you believe that your account or login information has been used without your permission, you must notify us in writing and change your password as soon as possible. By using the platform, you agree to use it as an individual, intellectual property, and not as an institution, larger entity, or group of individuals operating through a single account. Furthermore, you are authorized to share the Senmixmaster website, provided that these links are not posted on sites that contain pornographic, obscene, defamatory, or otherwise unlawful/harmful content. This permission is granted unless we request you to stop providing links to our site, at which point you agree to stop providing these links immediately.

If at any time we believe that your account violates the Privacy Policy, Terms of Service, Acceptable Use Policy, the law, or other policies mentioned above encompassed by Senmixmaster, or threatens the livelihood, privacy, or intellectual property rights of other individuals and/or entities, we reserve the right to terminate your account and/or remove the content you have shared on the platform. Termination may also occur if your activity or account exposes us to legal liability, interferes with our service to other users, or has a negative impact on other users.

Our Acceptable Use Policy describes acceptable and prohibited uses of the site. By using the site, you agree to use the site in accordance with the Acceptable Use Policy.

Use of Credits for Releases:
If the app is used for a song/audio track that is made available on iTunes, Spotify, or any other promotional or relevant media, you agree to include « mastered by Senmixmaster » in the credits section of said release, if possible. By using our platform, you agree to grant Senmixmaster permission to use said song/audio track and your name to promote our service.

Site Modification and Termination:
Senmixmaster is constantly seeking to improve its site. Accordingly, Senmixmaster reserves the right to make changes to its site at any time. We also reserve the right to terminate or completely discontinue the site. If we terminate or cancel the service, we will provide you with advance notice to retrieve any information belonging to you from the site, if providing such notice is reasonably possible.

INDEMNIFICATION
By using our service, you agree to defend, indemnify, and hold harmless Senmixmaster and its subsidiaries, agents, employees, successors, related parties, advertisers, directors, advisors, shareholders, officers, and affiliates (collectively, the « Affiliated Parties ») from and against any and all claims, demands, costs, expenses, liabilities, and damages, including legal fees, arising from your use of the site, your violation of these terms of service or other policies, and/or any intellectual property infringement or violation committed by you or your account on the site.

Third-Party Provider Disclaimer
By using our platform, you understand that the material and opinions shared by third-party sources on our platform are not representative of Senmixmaster or its affiliates. This third-party content therefore does not represent Senmixmaster or our opinions. Any third-party content shared on our platform represents the thoughts of the original creator only and is in no way endorsed by us. 

In the Event of Illicit Practices:
If, at any time, we believe that any aspect of this agreement is not being respected, we reserve the right to investigate any violations or actions and take any action we deem appropriate. This includes, but is not limited to, disclosing the information we obtain about you on the platform to government agencies and law enforcement authorities.

Payment Disclosure:
By using Senmixmaster and any paid offering on the platform, you warrant that all payment information provided during the transaction is true and complete, that the transactions you initiate will be processed by your bank or mobile money service, and that you agree to pay any additional amounts in the event that applicable taxes are due.

Legal Compliance:
By using Senmixmaster, you agree to comply with all applicable laws, ordinances (foreign and domestic), statutes, and regulations that govern your use of our platform and the materials and content associated therewith.

Disputes
You and Senmixmaster agree that any claim or dispute related in any way to these Terms of Service or your use of the Site will be resolved exclusively by final and binding arbitration, rather than in court. Arbitration will be conducted in the Senegalese courts under its rules and procedures. Arbitration proceedings will be conducted solely on an individual basis and not in a consolidated, class, or representative action. Arbitration proceedings will be held in Dakar, and each party will share the cost of arbitration. If for any reason, the claim or dispute proceeds in court rather than through arbitration, then you and Senmixmaster each agree to resolve the claim or dispute in a state court and submit to the personal jurisdiction of that court. and waive any right to a jury trial.
Notwithstanding the preceding paragraphs, you and Senmixmaster may bring an action in court to prohibit infringement or other misuse of intellectual property rights.

Governing Law
By using the Site, you agree that, except to the extent prohibited by law, the Terms of Use and any claim or dispute of any kind that may arise or has arisen between you and Senmixmaster, shall govern.

Severability
If any of the above Terms of Service is found to be unenforceable, void, or invalid, that term shall be deemed severable and shall not affect the enforceability and validity of any remaining Terms of Service.

General
No aspect of this Agreement constitutes a partnership or joint venture of any kind between you and Senmixmaster, its subsidiaries, agents, employees, interested parties, directors, advisors, shareholders, officers, and/or affiliates.
